This requirement isn’t part of cannabis-specific licensing—it’s part of New York State labor law and applies to all employers, including dispensaries, cultivation sites, manufacturing facilities, and testing labs.
🍼 What Does the Law Require?
Under New York State Labor Law §206-c, and further reinforced by New York City Human Rights Law, employers must accommodate breastfeeding employees in the workplace. This includes:
1. A Private, Non-Bathroom Space
Employers must provide a clean, private space (not a restroom) for employees to express breast milk. This space must:
Be close to the work area
Be shielded from view and free from intrusion
Include a chair, a flat surface, and access to clean running water
Include an electrical outlet (if the worksite has power)
NYC employers must go further, ensuring the lactation space also provides:
A refrigerator for storing milk
A clearly outlined lactation accommodation policy
Response to accommodation requests within 5 business days
2. Break Time
Employees are entitled to up to 30 minutes of paid break time for lactation, each time they need to express milk. This applies for up to 3 years following childbirth.
